Instead of answering, I went through all the responses thus far and made a spreadsheet of the answers. (This is absolutely non-scientific and possibly inaccurate, plus there's no data as to how well these strategies worked, but hey, I was curious and thought maybe others might be interested too.)
I also have a list of "Other" answers that didn't fit neatly in these boxes or struck me in some way-- I'll link those next.
Question for fellow #lawyers who practice in the areas of marketing and advertising in the U.S.:
Have there been any enforcement actions arising out of the FTC's Guides Concerning the Use of Endorsements and Testimonials in Advertising that do not involve fraud, e.g., for simply failing to state that a social media post by an influencer was sponsored?
I know they send out warning letters but I have not found anything that resulted in any sort of penalty. TIA

The image is emblematic of the computer industry marketing male gendered/privileged environments, women models, & inuendo & seduction to try to sell computing & software systems.
I view myself as an example of somebody that many in the #Fediverse would have probably given up on.
I'm a marketer. I've enjoyed the corporate social media platforms. So you'd look at me year ago, and you'd think: "now, this person would never join #Mastodon, she'd never care about the Fediverse".
But I did join! And I am advocating for the #openweb now.
watched a doc about #cambridgeanalytica … psychographic analysis is the reason why I got into marketing in the first place but once you uncover how rotten it is and what the big consequences are it’s just absurd to look at. the intersections of #politics , #marketing and #socialmedia with their implications need to be taught in schools, there must be data/media literacy courses taught to young people.
I'm caught between wanting our indie game to thrive and hating big tech platforms. I like it on the fediverse, its fun here and I like talking to people here. But I feel pressured to use Threads/twitter/etc since we've put so much work into the game and want as wide an audience as we can for our debut. It's tough and annoying.
