@bageera@blackmastodon Negligence does not count in the equation of whether civilians are being targeted. You cannot target civilians or the things civilians need to sustain life because someone else attacked civilians. In IHL there aren't really good sides and bad sides. Combattants from all sides of a conflict often commit war crimes. They all should get prosecuted at the end. Whether there was negligence is a political matter to be dealt with in a political way. IHL is not political.
