I'm actually shocked the TX legislature is doing anything remotely useful instead of fighting culture war battles. Good for them.

It's pretty wild

admiralteal,

This is just a rare case where the culture warriors have picked an appropriate enemy. Broken clocks and all that.

Culture warriors hate big tech because they believe big tech is "woke". Even while big tech bends over backward to protect the culture warriors' speech rights.

Soooo.... is the fine so low because they hope people will ignore it and they can generate revenue? Google, Facebook, and the big players who all will 100% break this law will pay $7500 everyday, all day and not even start to care.

7500 per instance of this happening (this is inline with other laws)

That stacks really quickly because if it violates it 100 times that is 750,000 thousand right there.

That is a small number. Something more reasonable would be much higher

Did this actually get past Abbott’s desk tho?

I tried to read the bill but got thrown off by the dozens of definitions before the text of the bill even begins. Are you aware of a good summary of what the bill does?

vudu,
axtualdave,

The TDPSA does not provide a private right of action.

Oh, so it’s a political thing that citizens can’t use without the Attorney General saying so.

This will be weaponized against companies Paxton doesn’t like.

tenet,

Assuming he's AG for much longer. He's already suspended from office pending his Senate trial, and they banned his wife from participating in the proceedings.

Paxton pissed off his supposed friends in the GOP (there are no friends in the GOP, only future crazy exes) by trying to pawn off a multi-millon dollar settlement against him on taxpayers... also for shitting on congress members for being drunk on the floor. You know, at work. Where anyone else would get immediately fired.

Requires small businesses, as defined by the United States Small Business Administration, to receive consent from consumers before selling consumers’ sensitive data;*

Why carve out exceptions.....

fbievan,
@fbievan@fedia.io avatar

No idea... Im used to that in Texas

getBoolean,

We all know why, they are on their payroll

fbievan,
@fbievan@fedia.io avatar

My theory is that small businesses are exempt, expect for consent.

I have to read the entire bill, to get an idea of exactly how it is worded, and what is intended.

I'll be back shortly

fbievan,
@fbievan@fedia.io avatar

ok... so unfortunately 'small businesses', which is dependent upon the SBA's definiton, seem to be exempt expect for the 'consent' clause

getBoolean,

That is unfortunate, thanks for taking the time to read it
