You can be recorded. Your likeness can’t be shared without your permission. But if you aren’t the subject of the photo/video, then it should be fine to share. (Think of a tourist uploading a picture they took at a tourist attraction with a crowd in the background…they aren’t the focus of the picture, so it’s ok to share/publish)

The onus is not on the sharer to prove that they’ve obtained consent to share likenesses, for better or for worse. But if your likeness is being misused, there are usually avenues to get it removed.

As for your example, I’m betting they either tricked him into signing, or offered him a lower penalty if he provided consent.
